For argument sake, lets say a vehicle has toughness18 and then take 20 points of damage. Less than a wound, so it would have to make a driving check or go out of control....correct so far?
If that vehicle is not moving, lets say it is hull down, does the vehicle escape from rolling anything for it does not make sense (to me) to roll for out of control?

Pretty much. If a vehicle isn't actually under control, it can't really go Out of Control. If it is effectively parked, there's no reason to roll.
However, that doesn't make a vehicle that is simply stopped immune. If a driver is still controlling the vehicle (in this case preventing it from moving is control), he could still lose control. His foot could slip off the brake, thus causing the vehicle to move as per the Out of Control table.
